1. คดีคุณจีรนุช เปรมชัยพร

วันที่ 1 มิถุนายน พ.ศ. 2552 ทางกองปราบปรามได้ ส่งสำนวนฟ้องคดีคุณจีรนุช เปรมชัยพร ผู้อำนวยการหนังสือพิมพ์
ออนไลน์ประชาไทไปที่สำนักงานอัยการแล้ว โดยที่ดร.ฉันทนา บรรพศิริโชติ หวันแก้ว จากคณะรัฐศาสตร์ จุฬาลงกรณ์มหาวิทยาลัย ได้ใช้ตำแหน่งประกันตัวคุณจีรนุชในชั้นอัยการ

จากนั้นอัยการได้นัดฟังคำสั่งว่าจะส่งฟ้องคดีนี้ต่อศาลหรือไม่ ในวันศุกร์ที่ 26 มิถุนายน พ.ศ. 2552

2. คดีคุณสุวิชา ท่าค้อ

วันที่ 1 มิถุนายน พ.ศ. 2552 คดีของคุณสุวิชา ท่าค้อ ได้ถึงที่สุดกลายเป็นคดีแดงแล้ว เนื่องจากอัยการมีคำสั่งไม่อุทธรณ์ต่อ
ดังนั้นคุณสุวิชา จึงต้องโทษจำคุก 10 ปี แต่สามารถเริ่มกระบวนการขอพระราชทานอภัยโทษได้อย่างที่ได้ตั้งใจไว้

We would like to inform you the update on two cases related to netizens;

1.The case of Ms.Chiranuch Premchaiporn:

June 1, 2009, Crime Suppression Division submitted the charges against Ms.Chiranuch Premchaiporn, director of Prachatai online-newspaper to the state attorney at the Office of attorney-general. She had to get bailed which she is guaranteed by the status of Dr.Chantana Banpasirichote-Wankaew, an academic from the Faculty of Political Sciences, Chulalongkorn University

Ms.Chiranuch is scheduled to hear the decision if she will be prosecuted by the state attorney on Friday 26, June 2009

2. The case of Mr.Suwicha Thakor:
June 1, 2009 his lawyer was informed that the case is officially closed since the state attorney decided not to appeal this case.

Mr.Suwicha can now begin the process to request for royal pardon as he intended earlier.

ใบแจ้งข่าวเครือข่ายพลเมืองเน็ต เรื่อง การดำเนินคดี พ.ร.บ. คอมพิวเตอร์ฯ ต่อพลเมืองเน็ต

ตั้งแต่พระราชบัญญัติว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2550 ประกาศใช้ในราชกิจจานุเบกษาไปเมื่อวันที่ 18 มิถุนายน 2550  ได้มีผู้ถูกดำเนินคดีจำนวนมาก หลายคดีส่งผลให้เกิดความวิตกกังวลในการบังคับใช้กฎหมายอย่างคลุมเครือขาด ความชัดเจน พลเมืองเน็ตตกอยู่ในบรรยากาศแห่งความกลัว โดยเฉพาะการตีความโดยเจ้าหน้าที่รัฐในบทบัญญัติความผิด มาตรา 14 และ 15

Thai Netizen Network considers the legal actions against these cases are very significant to the liberty of Internet citizens and Thai society. As a result, TNN would like to urge all netizens and the public to monitor the cases closely and carefully.

Also, TNN would like to urge the authorities concerned to treat the cases with careful consideration on the principles of human rights and humanity. As the cases are related to the right to hold opinion, political expression and press freedom, which are guaranteed under the Universal Declaration of Human Rights, these cases are distinctive from other ordinary criminal offences and that deserve careful treatment with the consideration of human rights.

เมื่อวานนี้ทราบข่าว ทางกองปราบปรามจะส่งฟ้องคดีของพี่จิ๋ว หรือ คุณจีรนุช เปรมชัยพร ไปที่อัยการเร็วๆนี้ หลังจากที่ได้มีบุกจับกุมสำนักงานของหนังสือพิมพ์ออน์ไลน์ ประชาไท www.prachatai.com เมื่อวันที่ 6 มีนาคม พ.ศ. 2552 ตามความผิดในมาตรา 15 ของ พระราชบัญญัติว่าด้วยการกระทำความผิดเกี่ยวกับคอมพิวเตอร์ พ.ศ. 2552 เนื่องเพราะในฐานะที่พี่จิ๋ว เป็นผู้ดูแลเวบเบอร์ดและไม่สามารถลบเนื้อหาใน comment ที่ไม่เหมาะสม ได้ทันเวลาตามที่ตำรวจตั้งไว้แต่พี่จิ๋วก็ยืนยันเจตนาบริสุทธิ์ว่าได้ให้ความร่วมมือก้ับเจ้าหน้าที่ตำรวจเสมอมาเมื่อได้รับแจ้งว่ามีเนื้อหาที่ไม่เหมาะสม  และได้ลบเนื้อหาดังกล่าวออกไปนานแล้ว

สำหรับผู้เขียนคิดว่า การดูแลเว็บบอร์ดเป็นเรื่องไม่ง่ายเลย เพราะมีความเคลื่อนไหวตลอดเวลา การใช้กฏหมายกำักับดูแลสื่อใหม่เช่นอินเทอร์เน็ตที่เหมาะสม ลงตัว ควรจะเป็นอย่างไร และ รัฐควรจะมีแนวทางในสร้างดุลยภาพให้เกิดขึ้นได้อย่างไร ที่จะไม่ไปละเมิดสิทธิเสรีภาพในการรับรู้ข้อมูลข่าวสารและการแสดงออกของประชาชน การแสวงหาโจทย์ที่ชัดเจนร่วมกันในเรื่องนี้ยากเหลือเกิน

สิ่งที่เกิดขึ้น บางครั้งก็ยากที่จะพูดความคิดความรู้สึกออกมาตรงๆ แต่ตนเองคิดว่า ส่วนหนึ่งเรื่องนี้เป็นปัญหาการใช้ พรบ.คอมพิวเตอร์ ฯ ที่มีความไม่ชัดเจนอยู่หลายประการ ไม่้ใช่แค่กรณี่ของพี่ิจิ๋วแต่ยังมีอีกหลายกรณี ที่ประสบคดีความเนื่องเพราะความเข้าใจไม่ตรงกันของการตีความกฏหมาย

หน่วยงานไหนจะช่วยแก้ไข ความคลุมเครือตรงนี้ได้บ้าง น่าจะมีการพูดคุย เปิดเวทีให้เสนอแนะเรื่องปัญหาที่เกิดขึ้นจากการใช้ พรบ.คอมพิวเตอร์ฯ โดยเฉพาะความคิดเห็นของ กลุ่มคนที่เรียกว่าเป็นพลเมืองเน็ตและผู้คนที่อยู่ในโลกออนไลน์ให้มากขึ้น

ยังมีงานอีกมากมายที่ต้องทำ แต่บางครั้งการทำงานเรื่องหลักการในประเทศไทยตอนนี้ก็เป็นเรื่องยาก

หรืออาจจะยากมาตั้งนานแล้วก็ได้  ตอนนี้ยังคิดอะไรไม่ออก รู้แต่ว่าในฐานะที่รู้จักพี่ิจิ๋วเป็นการส่วนตัวด้วย

ก็อยากจะให้กำลังใจ ไม่เครียดหรือกดดันมากเกินไป   เพราะยังหวังว่าเรื่องที่เกิดขึ้นนี้จะคลี่คลายไปได้ด้วยดี ด้วยความเป็นธรรม

ด้วยความรู้สึกเครียดๆแบบนี้ เมื่อได้กลับมานั่งดู clip วิดีโอ ของ เครือข่ายพลเมืองเน็ต (ThaiNetizenNetwork ) ที่จัดงานคุยไปกินไป

เมื่อวันที่  29 มีนาคม พ.ศ. 2552 ที่ห้องประชุม GM Hall จุฬาลงกรณ์มหาิวิทยาลัย ก็รู้สึก อบอุ่น  ขึ้นมา  ทำให้ยิ้มได้

บรรยากาศในงานเป็นกันเอง แม้คุยกันจริงจัง ถกเถียงในเรื่องของความคิดต่อสิ่งที่เรียกว่า “เสรีภาพ”  ความคิดเห็นหลายคนไม่เหมือนกันแต่ก็เคารพกัน ได้ฟังเหตุผลแต่ละคน ทำให้เราได้เรียนรู้เข้าใจผู้อื่นมากขึ้น การฟังคนอื่นพูดความคิดเห็นของเขาแม้เราคิดไม่เหมือนกัน แต่มันทำให้เราฉลาดขึ้นจริงๆ

ตอนท้ายของ clip ก็เป็นการร้องเพลง ‘กำลังใจ’ บทเพลงนี้ความหมายดี ฟังเมื่อไหร่ก็สร้างกำลังใจเงียบๆขึ้นได้ในความรู้สึกของเราเอง

Re to the case of Mr.Suwicha Thakor, Internet citizen whom convicted for 10 years in jail for posting sensitive clip online.  The public prosecutor asked Criminal Court for the extension 30 days to make decision whether to appeal the case or not.  This is the news update อัยการขอเลื่อนเวลาอุทธรณ์ คดี ‘สุวิชา ท่าค้อ’ ทนายชี้คดียืด ทำให้ขอพระราชทานอภัยโทษไม่ได้

Therefore Suwicha still could not start the process to request for royal pardon as his family had hoped since the case is not over yet.  If the prosecutor decided to appeal for tougher sentence, Suwicha has to stay longer in prison more than 10 years as he is currently convicted.  I hope the public prosecutor will not appeal this case  since 10 years in prison is severe enough to punish citizen.  According to the story published in prachatai.com, Suwicha was thinking of committing suicide and his wife lives in very desperate situation.  I also hope he will not do so for any reason.

On the day when I was attending the verdict session on his case at Criminal Court on April 3, 2009 as part of my work for Thai Netizen Network  and for my own interest in this case.

I saw Suwicha’s wife but did not have much chance to talk with her since she also decided not  to sit in the room with other members of his family.  She might have been too scared to listen it directly.  However, her fear came true afterward.

She dressed simple but pretty despite  sad appearance.  I remember she wore white top with pink color on it,  saying Love Love Love Love and many more Love letters painted on her top cloth.  I thought on that day she was very sweet lady.  She might intended to show her affection toward her husband who was behind bars.

As a woman myself, if I would have been in her position, what I supposed to do. It might be very hard.

Not only Suwicha’s soul is kept in iron cell but his loved one’s heart is sentenced within her own mind as well.

Hope she could free her soul and carry on her duty in family with 3 children with  hope and little  joy if it remains.

I am speechless today after reading this news in prachatai.com and also receiving update from the lawyer about the case of  Suwicha Thakor, Internet user who sentenced 10 years in jail,  that he could not seek for royal pardon since the case is not over yet.

‘Please help me! I’ve no one to turn to,’ Thitima Thakor panicked over the phone in the morning of May 12.

‘What’s happened?’

‘Five days ago, Nui (Suwicha’s nickname) was transferred to Zone 7. The other inmates forced him to be tattooed. There are 37 people in his cell. Nui was scared. He didn’t yield. He told me if he was tattooed, he would kill himself,’ Thitima anxiously spoke of the latest situation for her husband, Suwicha Thakor, who was sentenced to 10 years in prison for posting lèse majesté content on the internet.

Listen and talk to the other person in a deep and loving way are not easy but do it to your own heart is even more difficult. When the head gets confused and the heart gets hurt, it distracts yourself from your own mind but to rely or depend on something that is out.  It is not simply to just listen and talk to your mind deeply with a loving manner unless you do practice it regularly. Everyday, so many feelings and sensation arise to our mind either to satisfy or disappoint us. We cannot really control anything.  Looking in your own heart, you may seek some solution if you do not completely sink  in such hopeless mind but looking into Thai society, you do not see any solution that could bring Thailand out of the crisis in near future yet, of course true JUSTICE will definitely bring peace (which very difficult to gain) but to stabilize it we do need also a compassion and mutual understanding. The role of communications must fulfill.  I believe in the power of communication, it can bring peace or war, though I have been doubted by the role of political media which highly enjoyed freedom producing hatred and condemnation, it went  against the construction of peace within our own mind and society,  however, I still insist that various kinds of medium shall be allowed to convey people’s concerns and diverse opinion, equally and fairly. Trying to stop people to speak or shout will even lead them to the incitement of violence. Why no one ever learned the simple lesson that trying to block expression means encouraging them to fight and sacrifice. The great lesson from May 1992 is still meaningful to think again. I am going to join the panel discussion  on the occasion of 17 years of May 1992 at the 14 October Memorial building on this  Sunday. I am going to talk about this. Currently, Thai Govt still does not allow the opponent voices, Red-shirted media to continue, I would urge Democrat Government and National Telecommunication Commission (NTC) to implement the policy that allows Red-shirted media to play its role based on its rights and freedom. Then NTC shall try to have both groups (Red and Yellow’s media) engaged to discuss the code of conduct for exercising free speech that should come with more respect and responsibility.

I know it is very idealistic but nobody has attempted to do it yet, it is worthy to try.

On Sunday 10th, May 2009, Red-shirt movement calls for a mobilization in town once again, it would lead to another incident or not, nobody knows. Hatred feeling has been so much reproduced since anti-Thaksin movement started in 2006, now anti-Democrat movement also has continued the hatred sensation within another group. Political media and speech have become tool to condemn and build hatred, it is powerful than the role to build love and harmony, obviously. Some people believe that conflict would lead to real change but I think that the compassion would do.

Before ending my note today, I would like to quote these sentences and contribute to Thai society, the power-holders, all stakeholders and every individuals.

As the conflict escalates and the government reverts to crude censorship and veiled threats, all kinds of journalists here are bracing for what they fear could be an assault on their ability to neutrally gather and present the news, and a blow to press freedom.
